Background<\/h3>\n<p data-start=\"1319\" data-end=\"1453\">A client instructed her bank to execute three transfers (EUR 90,000 in total) to a German account in order to invest in crypto-assets.<\/p>\n<p data-start=\"1455\" data-end=\"1582\">After losing the funds, she brought a claim against the bank, alleging a failure to warn and a breach of its duty of vigilance.<\/p>\n<p data-start=\"1584\" data-end=\"1648\">The Court of Appeal found the bank partially liable, relying on:<\/p>\n<ul data-start=\"1650\" data-end=\"1766\">\n<li data-start=\"1650\" data-end=\"1680\">the high amounts involved,<\/li>\n<li data-start=\"1681\" data-end=\"1724\">the unusual nature of the transactions,<\/li>\n<li data-start=\"1725\" data-end=\"1766\">the foreign destination of the funds,<\/li>\n<\/ul>\n<p data-start=\"1768\" data-end=\"1847\">and held that the bank should have warned the client against risky investments.<\/p>\n<hr data-start=\"1849\" data-end=\"1852\" \/>\n<h3 data-start=\"1854\" data-end=\"1881\">2. Supreme Court ruling<\/h3>\n<p data-start=\"1883\" data-end=\"1925\">The Supreme Court overturned the decision.<\/p>\n<p data-start=\"1927\" data-end=\"1940\">It held that:<\/p>\n<blockquote data-start=\"1942\" data-end=\"2113\">\n<p data-start=\"1944\" data-end=\"2113\">when a bank executes a transfer for investment purposes, it acts as a payment service provider and is not subject to any duty to advise or warn regarding the investment.<\/p>\n<\/blockquote>\n<p data-start=\"2115\" data-end=\"2127\">As a result:<\/p>\n<ul data-start=\"2129\" data-end=\"2198\">\n<li data-start=\"2129\" data-end=\"2155\"><strong data-start=\"2131\" data-end=\"2152\">no duty to advise<\/strong>,<\/li>\n<li data-start=\"2156\" data-end=\"2198\"><strong data-start=\"2158\" data-end=\"2197\">no duty to warn on investment risks<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"2200\" data-end=\"2295\">This approach is consistent with the principle of <strong data-start=\"2250\" data-end=\"2294\">non-interference in the client\u2019s affairs<\/strong>.<\/p>\n<p data-start=\"2297\" data-end=\"2571\">This must also be read in light of the PSD2 framework governing payment services:<br data-start=\"2378\" data-end=\"2381\" \/><a class=\"decorated-link\" href=\"https:\/\/droitbancaire.be\/psd-2-projet-de-loi-portant-modification-insertion-de-dispositions-matiere-de-services-de-paiement-differents-livres-code-de-droit-economique-a-ete-depose-gouvernement\/\" target=\"_new\" rel=\"noopener\" data-start=\"2381\" data-end=\"2571\">https:\/\/droitbancaire.be\/psd-2-projet-de-loi-portant-modification-insertion-de-dispositions-matiere-de-services-de-paiement-differents-livres-code-de-droit-economique-a-ete-depose-gouvernement\/<\/a><\/p>\n<hr data-start=\"2573\" data-end=\"2576\" \/>\n<h3 data-start=\"2578\" data-end=\"2617\">3. Limited duty: apparent anomalies<\/h3>\n<p data-start=\"2619\" data-end=\"2667\">The bank remains subject to a duty of vigilance.<\/p>\n<p data-start=\"2669\" data-end=\"2753\">However, this duty is strictly limited to detecting <strong data-start=\"2721\" data-end=\"2743\">apparent anomalies<\/strong>, meaning:<\/p>\n<ul data-start=\"2755\" data-end=\"2863\">\n<li data-start=\"2755\" data-end=\"2784\">objective irregularities,<\/li>\n<li data-start=\"2785\" data-end=\"2822\">detectable without investigation,<\/li>\n<li data-start=\"2823\" data-end=\"2863\">by a reasonably diligent professional.<\/li>\n<\/ul>\n<p data-start=\"2865\" data-end=\"2940\">The bank is not required to assess the relevance or risk of the investment.<\/p>\n<hr data-start=\"2942\" data-end=\"2945\" \/>\n<h3 data-start=\"2947\" data-end=\"2998\">4. What does not qualify as an apparent anomaly<\/h3>\n<p data-start=\"3000\" data-end=\"3078\">The Court implicitly clarified that the following elements are not sufficient:<\/p>\n<ul data-start=\"3080\" data-end=\"3170\">\n<li data-start=\"3080\" data-end=\"3109\">high transaction amounts,<\/li>\n<li data-start=\"3110\" data-end=\"3135\">unusual transactions,<\/li>\n<li data-start=\"3136\" data-end=\"3170\">transfers to foreign accounts,<\/li>\n<\/ul>\n<p data-start=\"3172\" data-end=\"3223\">even when they involve the client\u2019s entire savings.<\/p>\n<hr data-start=\"3225\" data-end=\"3228\" \/>\n<h3 data-start=\"3230\" data-end=\"3259\">5. Practical implications<\/h3>\n<p data-start=\"3261\" data-end=\"3300\">This decision is important in practice.<\/p>\n<p data-start=\"3302\" data-end=\"3305\">It:<\/p>\n<ul data-start=\"3307\" data-end=\"3475\">\n<li data-start=\"3307\" data-end=\"3352\">limits attempts to extend bank liability,<\/li>\n<li data-start=\"3353\" data-end=\"3415\">refocuses litigation on the concept of apparent anomalies,<\/li>\n<li data-start=\"3416\" data-end=\"3475\">prevents banks from being treated as investment advisors.<\/li>\n<\/ul>\n<p data-start=\"3477\" data-end=\"3656\">It should also be read together with case law on fraud and phishing, where the client\u2019s gross negligence is often decisive:<br data-start=\"3600\" data-end=\"3603\" \/><a class=\"decorated-link\" href=\"https:\/\/droitbancaire.be\/phishing-responsabilite-banque\/\" target=\"_new\" rel=\"noopener\" data-start=\"3603\" data-end=\"3656\">https:\/\/droitbancaire.be\/phishing-responsabilite-banque\/<\/a><\/p>\n<hr data-start=\"3658\" data-end=\"3661\" \/>\n<h3 data-start=\"3663\" data-end=\"3680\">6.
